Police: Widow in Sun-Drop case embezzled from her employer
August 4, 2008
CONCORD — Concord Police have charged a 43-year-old woman with embezzling more than $60,000 from her employer over four years.
Tressy Hackett Noles also happens to be the widow of one of two people murdered June 13 at Sun-Drop Bottling Co. of Concord.
But the Police Department indicated in its press release that the embezzlement has nothing to do with the murder of Darrell W. Noles, 44.
The Police Department said it was already investigating Tressy Noles before her husband’s shooting death. So far, no one has been charged in the Sun-Drop murders.
Police officials decided to delay serving the embezzlement warrants “out of respect for the grieving Noles family.”
“The decision to move ahead with these charges at this time has been a difficult one,” Concord Police Chief Merl Hamilton said in the press release. “We are bringing these charges at this time as the investigation is complete and to fulfill our obligation to the victim of the embezzlement” and the community.”
An employee of Spectrum Sales until April, Tressy Noles is accused of embezzling money between 2004 and 2008.
Police have said previously Noles went to the Sun-Drop plant June 13 to apply for a job. Donna Barnhardt, 59, the other shooting victim, had worked at the company for 18 years.
Police say the shooter walked into the plant’s office around 10 a.m. during what they believe was a robbery. Two employees working at the facility who did not hear the gunfire later found the bodies and called 911, he said.

Sex offender refuses to leave church
August 4, 2008
Staff report
Police arrested a registered sex offender Sunday morning after he refused to leave the children’s area at a church.
Ricky Jo Asbury, 40, of 203 E. 20th St. is charged with disorderly conduct in a religious assembly and second-degree trespass.

Teachers quickly moved children out of the area, but Asbury remained.
According to information contained in the warrants, Asbury told church officials he was not leaving, and “they could not make him (leave), and if the church made him leave, he would sue.”
Church officials had previously advised Asbury to stay away from the children’s area.
Asbury was placed in the Rowan County Detention Center with $1,000 bond.
Teen driver gets 18 months probation in brother’s death
August 4, 2008
Staff Report
CONCORD — A Concord teenager has pleaded guilty to misdemeanor death by vehicle in the death of his 17-year-old brother.
A Cabarrus County court clerk said Darius Lee Agnew, 16, received a suspended jail sentence and 18 months probation. A judge dismissed a charge that Agnew was driving with a revoked license when he caused the accident that killed his brother. The jail sentence could be invoked if he violates probation.
The Concord Police Department said Darius Agnew, of 44 First St. N.W., Concord, was charged with misdemeanor death by vehicle July 30, appeared before a Cabarrus County District Court judge around noon last Thursday and pleaded guilty.
The Police Department did not say what sentence Agnew received, saying instead, “The Cabarrus County Clerk of Court is the point of contact for the record of the conviction and sentencing.”
In its press release, the Police Department said Darius Agnew “accepted responsibility for his actions that took the life of his brother, Brandon McArthur Agnew, 17.”
“The judge accepted his plea and sentenced (Darius) Agnew at his (Agnew’s) request,” the police press release said. “The family wanted to begin the process of rebuilding their lives and knew it was important for Agnew to get this phase of the healing process behind him.”
Brandon Agnew died July 12 when he was a passenger in the back seat of his mother’s 2003 Chrysler PT Cruiser. Darius Agnew was driving the car around 3 a.m. that Saturday when he lost control on Zion Church Road near the Litaker Lane intersection.
The PT Cruiser careened off the roadway, went airborne and rolled over. Brandon Agnew was thrown out of the car from the back seat and suffered fatal injuries.
A helicopter flew him to Carolinas Medical Center in Charlotte, where he died at 5:34 a.m.
The Police Department said the brothers took the car as their mother was sleeping, and the mother was not aware her sons had left home. A cousin, Nicolas Brian Mitchell, 16, also of Concord, was riding in the front passenger seat and suffered injuries that were not life-threatening.
“The Concord Police Department sends our deepest sympathy to the Agnew family,” the press release said.
