Woman accused of choking officer

By Frank DeLoache
Kannapolis Citizen
When state alcohol agents and Kannapolis police visited a store last week, police say the clerk behind the counter was on the phone.
And she wouldn’t hang up.
Relations went down hill from there.
Agents went to the Hispanic grocery store near Big Lots on North Cannon Boulevard at 9:45 a.m. April 30. Plainclothes Kannapolis officers accompanied agents for the N.C. Alcohol Law Enforcement Division.
The state agents went in the store first and then asked the police officers to come in.
A later report said the clerk was talking in Spanish and to the officers in English.
Lt. Bret Johnson said the Kannapolis officers, with their badges displayed, asked the clerk repeatedly to hang up and cooperate with the state agents.
“She used some expletives and said she didn’t have to hang up the phone — he didn’t pay her phone bill,” Johnson said.
Finally, officer Terry Spry walked behind the counter and reached to hang up the phone.
The clerk hit Spry once in the chest and started choking him, the report says.
At 6 feet 5 inches, Spry is a big man, Johnson said, and the report describes the clerk as 4 feet 11 inches and 130 pounds.
“He just removed her hands and put her under arrest,” Johnson said.
The report does not indicate anyone else was working at the store at 745 N. Cannon Blvd. at the time.
Spry charged Lisette Garcia, 32, 1579 Duckhorn St., with simple physical assault. She posted $500 bond.
